Terms of service
1. About these Terms
These Terms and Conditions apply to orders placed through paxscrubs.com by consumers purchasing from PAX SCRUBS Ltd, referred to as “PAX Scrubs”, “we”, “us” or “our”.
Please read these Terms before placing an order. By placing an order, you agree to these Terms. Nothing in these Terms affects your statutory consumer rights.
The Terms applicable to an order are those displayed on paxscrubs.com when the order is placed. We may update these Terms from time to time, but changes will not apply retrospectively to an order already accepted by us.
2. About PAX Scrubs
PAX SCRUBS Ltd is a company registered in England and Wales.
Company number: 14410509
Registered office: 17 Ray Mill Road East, Maidenhead, SL68SW
Email: sales@paxscrubs.com
3. Using our website
The content of paxscrubs.com is provided for personal, non-commercial use. All intellectual property rights in the website, branding, photographs, designs, text and other content belong to PAX Scrubs or our licensors.
You must not misuse the website, introduce malicious software, attempt unauthorised access, interfere with its operation or use its content for unauthorised commercial purposes.
Nothing in these Terms prevents a customer from making an honest review, complaint or statement about their experience, or from exercising any legal right.
4. Products and availability
We take reasonable care to ensure that product descriptions, photographs and prices are accurate. Colours and appearance may vary slightly depending on lighting, photography and display settings.
All products are subject to availability. Displaying a product on our website does not guarantee that it will remain available. We may withdraw or discontinue products at any time.
If we are unable to supply an item after you place an order, we will notify you and refund any payment received for that item.
5. Placing an order
After placing an order, you will receive an acknowledgement email. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A binding contract is formed when we send confirmation that the order has been accepted or dispatched, whichever occurs first.
We may decline or cancel an order before acceptance where, for example:
- the product is unavailable;
- payment cannot be authorised;
- the price or product information contains an obvious error;
- we cannot deliver to the address provided; or
- we reasonably suspect fraud or unlawful activity.
If payment has already been taken for an order we cannot fulfil, we will refund it using the original payment method.
6. Prices and payment
Prices are displayed in the currency selected on our website. PAX SCRUBS Ltd is not currently registered for UK VAT, and no UK VAT is charged as a separate component of the price. Delivery charges and any other charges collected by us will be displayed before the order is submitted.
Then retain the following paragraphs in both versions:
We take reasonable care to ensure prices are accurate. If we identify an obvious pricing error before accepting an order, we may reject the order and refund any payment received.
Payment must be made using one of the payment methods available at checkout.
7. International orders and import charges
International orders are dispatched from the United Kingdom.
Unless expressly shown as collected at checkout, the amount paid to PAX Scrubs does not include destination-country import VAT, customs duty, postal handling charges, customs-clearance fees or other import charges.
These charges are determined by the destination country or delivery provider, are payable by the recipient and are separate from the delivery charge paid to PAX Scrubs. We cannot confirm their amount in advance.
Customers are responsible for ensuring that products ordered can lawfully be imported into the destination country.
8. Delivery
Available delivery options, estimated delivery periods and charges will be shown before an order is submitted and confirmed by email.
Delivery periods are estimates unless we have expressly agreed a guaranteed delivery date. International orders may be delayed by customs processing or circumstances outside our reasonable control.
Unless a different delivery period has been expressly agreed, we will deliver goods without undue delay and normally within 30 days after the contract is formed.
If delivery is delayed, please contact sales@paxscrubs.com. Where required by applicable law, you may provide us with a reasonable additional period for delivery. If we fail to deliver within that period, you may terminate the contract and receive the refund required by law.
No additional period is required where we have refused to deliver or where delivery by an agreed date was essential, taking account of the circumstances and information provided before purchase.
We may temporarily restrict delivery to particular locations where delivery is unavailable or materially disrupted.
9. Responsibility for goods during delivery
We remain responsible for the goods until they are delivered into your physical possession or the physical possession of a person identified by you to receive them.
This does not apply where you independently commission a carrier that was not offered or arranged by us.
Please contact us promptly if an order is lost, damaged or incorrectly delivered.
10. Refused and uncollected international parcels
If an international parcel is refused, not collected or returned because the recipient does not pay an import charge that was clearly disclosed before purchase, we will normally process the applicable refund after the parcel has been returned to us.
Where permitted by applicable consumer law, we may deduct actual return-to-sender charges incurred by PAX Scrubs. We will explain any proposed deduction and it will not exceed the actual cost incurred.
Customers must provide reasonable information in their possession that is needed to trace or recover a parcel, including tracking information and copies of postal or customs notices.
Customers must notify us promptly if a cancelled or refunded parcel is subsequently delivered and retain the goods while reasonable return arrangements are provided.
Nothing in this section limits statutory rights relating to delayed delivery, faulty or misdescribed goods, or import charges that were not properly disclosed before purchase.
11. Cancellation, returns and exchanges
Your cancellation and return rights are explained in our Return and Refund Policy, which forms part of these Terms.
Eligible online purchases may generally be cancelled within 14 days after delivery. After notifying us of cancellation, the goods must ordinarily be returned within a further 14 days.
Customers are responsible for the direct cost of change-of-mind returns where this was disclosed before purchase, unless we agree otherwise or applicable law requires us to pay.
A prepaid return label may be obtained through our returns portal for £2.99. Where selected, this amount may be deducted from the refund as the direct cost of return postage. It is not a restocking or administration fee. Customers who arrange and pay for their own return will not also be charged this amount.
Statutory cancellation exceptions may apply to goods made to the customer’s specifications or clearly personalised, including bespoke embroidered goods.
Nothing in this section limits rights relating to faulty, damaged, incorrect or misdescribed goods.
12. Refunds
Refunds will be issued using the original payment method unless otherwise expressly agreed.
Where a statutory change-of-mind cancellation applies, we will provide the refund within the period required by law. For returned goods, we may withhold the refund until we receive the goods or evidence that they have been sent back, whichever occurs first.
For a complete statutory cancellation, we will refund the least expensive standard outbound delivery charge offered for the order. Supplementary amounts paid for express or enhanced delivery are not refundable unless required by law.
We may make a lawful deduction where handling beyond what is reasonably necessary to inspect the goods has reduced their value.
13. Faulty or incorrectly supplied goods
Goods must be as described, fit for purpose and of satisfactory quality as required by applicable law.
If an item is faulty, damaged, incorrect or not as described, please contact sales@paxscrubs.com as soon as reasonably possible. We may request photographs or other reasonable information to investigate the issue.
Any request to contact us within a particular period is intended to assist our investigation and does not restrict statutory rights.
14. Our liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- breach of statutory consumer rights.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.
Nothing in these Terms limits any remedy that cannot legally be limited.
15. Events outside our reasonable control
We are not responsible for delay caused by events outside our reasonable control. If such an event materially affects delivery, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.
This section does not remove any statutory right to cancel an order or receive a refund.
16. Personal information
We process personal information in accordance with our Privacy Policy.
We may share necessary delivery and contact information with payment providers, delivery providers and other service providers involved in fulfilling an order.
17. Governing law and disputes
These Terms and contracts made under them are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, you retain the benefit of any mandatory consumer protections that apply in your country of residence. Nothing in these Terms prevents you from bringing proceedings in any court available to you under applicable consumer law.
Please contact sales@paxscrubs.com first so that we can attempt to resolve any complaint.
18. General provisions
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
A delay in enforcing a right does not waive that right.
Only the customer and PAX SCRUBS Ltd may enforce the contract, except where applicable law provides otherwise.
